Managing the Consequences of the Japanese Lifetime Employment System and Labor Law Update
Guest Speaker:
Mr. Peter Godwin, Partner, Herbert Smith LLP
(This presentation was conducted in English.)
Mr. Godwin returned to update IBA members on the important issue of redundancy and outlined the strategic decisions required to resolve issues arising from termination and the reasons behind those decisions. Specifically, this session addressed:
• The common complaints of HR personnel and in-house counsel;
• The different approaches to managing a termination and the consequences of each;
• Why the same mistakes are made repeatedly; and, most importantly
• Why you should not be afraid of litigation.
He also addressed other relevant labor law issues including overtime provisions facing financial institutions during the past 12 months and the role of the HR department during FSA inspections.
Peter has represented clients in arbitrations, mediations, public inquiries and in the courts of various jurisdictions. Peter is recommended as a leading individual for dispute resolution in the Asia Pacific Legal 500, 2002-2003, 2003-2004 and 2004-2005. He addressed the IBA Human Resources Information Forum in November 2005.
